what would foxtons do if we didnt pay the last months rent

We unfort used foxtons last year. We were overseas and rented a place in london. They lied about everything. Was supposed to be fully furnished, we arrived after 24 hour flight, no utensils, no nothing. When we tried to get out of our lease they said this was fine and wouldnt charge fees but couldnt possibly put this in an email so we trusted them, only to find out that they were planning on charging us the last 12 months commission.

We signed for a 12 month lease, then find out they changed this and made us sign a 18 month lease - we were overseas at the time.

Even though we have all this correspondance on email, they say they cant do anything as it is the lease that is legally bounding not the emails.

 

We are moving out 1st June as are thinking of not paying the last 6 weeks rent as we know they will try and take our 6 week security deposit for no reason. Is there anything they can do? My friends say everyone does this and not to worry but i just wanted to check. I really hate them.

You should have had

You should have had distance selling regulations in your contract. If these were not there, take legal advice on how you can implement them anyway as it is part of statute.

 Your deposit will be protected by either the TDS or DPS. You should have a certificate or something detailing this. Ask them. They will not be able to withold the deposit even if they want to. However, if you dont pay, the deposit will be held against loss of rent and you would still be chased by the landlord for the cost of any damages.

Did you not read the lease before you signed it? I dont see how they made you sign an 18 month lease without you realising it. If you did not bother to read the lease, there is not a lot you can do about it!!!
