The Implication of OFT V Foxtons

I have looked at some of the comments made by the great and good in the legal field concerning the outcome of the latest case involving Foxtons and the OFT.

A clear consensus has emerged. Lord Justice Mann, presiding, has indicated that Foxtons terms and conditions were not clearly flagged up and therefore the imposition of continued commission on rented property should not be allowed - IF YOU ALREADY HAD A RENTAL CONTRACT WITH FOXTONS AT THE TIME OF THE LEGAL DECISION. If so and they now send a letter requesting a commission of 7% you are almost certainly within your rights to reject it as the original terms did not make it clear that you would be further charged for the tenancy after the original term expired. If the tenant is carrying over there are no fees to pay Foxtons.

They have now amended their terms and conditions to make it clearer but they will lose commisssion on exiting tenancies where tenants hold over. Chek out legalbeagles for further info.

Ombudsman for Estate Agent V Foxtons

On the 4 July 2008 The Ombudsman for Estate Agent made its decision after I complained about Foxtons to them.

The Ombudsman made an award of £500 in compensation to be made for those aspects of the complaints that he supported. The Ombudsman decided that I suffered avoidable and undue distress, aggravation and inconvenience as a result of failures by Foxtons.

The Chief Executive of Foxtons Michael Brown and the area manager of Muswell Hill area were both extremely rude even after I told them that they breeched the Ombudsman's code of conduct. Micheal Brown's letter were very rude, he even ordered me to not call any Foxton's employee lol it was like a joke. I hope he had his lesson with the Ombudsman's decision

 I got my cheque and had a lovely holiday in Portugal.

Do I have a genuine claim?

Hi,

We signed a conract with Foxtons and recently found out that the person we thought was the land lady (who signed the tenency contract) is actually the long term tenent of the real owner. The real owner visited and she's siggned another agency to sell her property. This means we have absolooute strangers walking into our apartment, escorted by someone we dont have a contract with.

We'd like to move out early, but as the rent is pre-paid - do I have a legal right to demand the remaining ent back?

Do I have a genuine claim?

Foxtons have not done their job to establish who the correct landlady for the proeprty is. So yes legally the person who signed your lease claiming to be the landlord is not entiteld to your monthly rent and in fact has opened herself up to be prosecuted for taking money by deception, which can I believe be punishable by a prison sentence or a hefty fine.
