Have other landlords received a letter from Foxtens offering to let you terminate their contract?

Significantly letters are dated 11 July 09, the day after the High Court decision against them.

 Looks like they are trying to duck out when they know they now have landlords that don't owe  them anything in light of High Court decision, or that it might be the reverse -- Foxtons owing landlords.

 Thoughts?

Foxtons are suing me

Foxtons are taking me to court for the 50% of their fees I refused to pay on sale of my house 3 years ago. I paid half their fees as I considered this reasonable given that they breached the contract terms and provided me with inadequate customer care.

I've received a trial bundle from Foxtons that includes email and phone evidence that they did indeed breach the contract terms and then withheld the breach until it was too late for me to realistically back away from completion without causing myself unreasonable costs and complications. This was because I had to leave the country for work and the house we were buying was a quite unique property that my wife had set her heart on.

Foxtons have inadvertently let me know the basis on which they are contesting the case; that since I continued with the sale after discovering the breach, it is not a valid reason in law for withholding half their fees.

I'm looking for anyone that has had similar experience, as well a very good court solicitor that fancies taking on Foxtons.

Legal firms suggesting a 6 year retrospective period

I noticed one legal firm inviting cases where Foxtons have charged for continuation commission on tenancies going back as far as 6 years (statute of limitations). It liiks as though the legal establishment think there is a good chance of recouping fees where Foxtons continued to charge commission after the initial rental term.

Also the charges where sales commission has been levied following the sale of the property to the tenant has been adjudged as unlawful 

 

Class action?

Ermm...whats the name of the solicitors going for this 6 year cut-off? I am a landlord who has paid about £8000 in continuation fess to `em over that time.

class action

I want to join a class action against Foxtons for renewal charges. They verbally undertook not to charge renewal fees but their undertaking was not present in documentation. They were therefore  paid renewal fees that we now wish to reclaim.

Does it apply now?

Their terms and conditions currently state 11% for first twelve months and seven percent after this, is this lawful
