Foxtons entered our property without permission - and stole our new table and chairs!

Hi all,

 Maybe you could give us some advice on where we stand here. We got in touch with Foxtons to let them know we had bought a new set of table and chairs (worth 700 pounds) and asked if the landlord was able to pick up the previous table and chairs (cheap looking).

We've never let anyone enter our property without us being here before (we have had to organise contractors to come around several times) but our property manager seemed to decide it was ok for the landlord to come round anyway without speaking to either of us.

The story gets worse, however, as not only did the landlord come around unathorised but instead of taking the cheap plastic table and chairs he decided to take the £700 oak ones.  Not only were we greeted with no table and chairs on our return home, but there is a also a chunk missing out the wall, so the table or chairs were obviously hit against the wall with some force. Can you please advise on this aswell - since I don't want to fork out for damage we didn't do - and i'm also worried our table and chairs have been damaged.

 I hope that's all clear - this is very upsetting as you can imagine!

I've spoken to a member of the 'emergency' property management team (as its after 6) and she was very arrogant saying apparently it's our fault and he had a right to come around as we were left an answerphone message on one of our mobiles!!

Your agent and/or landlord

Your agent and/or landlord must give you 24hrs notice, leaving a message on a mobile is not acceptable. Make a formal complaint to ARLA.

I think you need to get a grip, you wanted the table removed, the fact that your landlord considered this is pretty good, your landlord obviously made a simple mistake.

Love that you called the 'emergency' line, I'm shocked and appalled that this wasn't resolved immediately that evening...

If this is all it takes to get you upset, your seriously sheltered.

get  a life.. obviously you must be a thieving bastard yourself if you think its an over reaction to having your new table and chairs removed from your property. You must be so chilled to the point of having no brain or common sense. I imagine you must be making such similar mistakes and taking peoples things yourself thus justifying other doing it.... get a life yourself!

It's funny that the people who are paid to defend foxton's shocking behaviour are such dumbasses.

Do you really think abusing people making the complaints make things better? It just makes your company look so much worse.

Guess what - we all know you're paid to do this, and also that you're very bad at your job.

It was quite clear that this wasn't a mistake, and it was completely against the law!

How about you just go back to whatever part of your mind that doesn't care about work and you can pretend that you're not a bad person.

Also just to let you know, you dont need to give 24hr notice. It clearly states that they must give ' reasonable notice '. I rent from Foxtons aswel and I doubt they would steal your £700 table. I suggest you call and speak to someone actually in the property management team and explain in propery.

IF they did indeed enter the premises and you had something stolen then dont even bother with foxtons.... go straight to the police and then a solicitor.

Haha, I think I know the branch your talking about as I was offered a new table and chairs for £150 when I moved into my newly rented appartment from foxtons. It did seem a bargain at the time and I accepted them. If you have not had any luck in gettng them back then message me and you can come and see if they are the ones stolen from your property.

Theft of your table and chairs

I work in property management and would not even consider entering a tenants apartment without the correct 24 - 48 hour notification and consent - you also have the right to refuse access unless in emergencies or works being required to the property and even then they still have to request reasonable notice, but you can insist that anyone entering your property does so accompanied or in your presence.  The owner does not have the right to enter.

Photograph the damage immediately, make a statement listing the damage caused and the theft, assuming your new table has been damaged if the wall has been? (you would have thought the owner must have been aware of what furniture is his)?  Send a copy by recorded post to the manager and managing director of Foxtons head office and put a claim in for the full cost of the table and chairs and compensation for tresspass, also demand that they send someone out to repair the damage. If you do not get a satisfactory reply keep ringing head office or go in person - be demanding and keep on at them.

 It is outrageous, it is unprofessional and is also theft so also go to the police.

 Estate Agents have a bad name but Foxtons seems to be top of the list.

Don't give advice unless you know what you are talking about - no one has the right to enter your home without consent even a baliff can't, police, I.R and VAT even have to obtain warrants to enter. Your home whether owned or rented is private and the tenant has the right to refuse entry without a warrant.  You can also change the locks so that you are the only keyholder providing you don't damage anything and providing you put the originals in place when you leave.

So how are Foxtons at fault? Surely it's the landlord to blame for entering unannounced?!

is 24 hours in legal terms.  Your rights as a tennant are very clear in legal terms (and Foxtons know this).
