HELP!
Hi There,
1 Week ago I moved into my new flat which I got through foxton's. Within days I wanted out of my 9 month contract. The people who live above me are music producers and continually play hard techno through the day and night. Its so loud sometimes the windows of the house shake and the cieling vibrates. Aside from the music problem with this being an old town house conversation I can hear EVERYTHING from upstairs. My neighbors are nocturnal too, staying up till 4am and trying to make as much noise as possible. Ive spoke to Both Foxtons and my landlord and said I wanted to leave but it seems Im locked into 9 months and it will have to go through the council to get the niose sorted. This has ruined the property for me and I just want to cut my loses and get out. What will happen if I walk from the contract? Can they sue me?
I have a history of sleep problems and cant stand another night in there, its gotten to the point where Im now staying with friends.
Any info would be amazing.

This sounds like a bit of a nightmare. I am a Letting Agent and Landlord and have come across this problem a lot of times before. Walking away from the contract is not advisable as you are legally bound for the next 9 months. One option to to do is to contact enviornmental agency, but this will be a lengthy process. The other option is to talk to the agent/landlord and see if they will let you move out if they can find a new tenant. You would have to pay rent up until the new tenant moves in and the agent/landlord may charge you re-advertising fees/administration fees etc. It worth asking the question
Talk to the Council and other neighbours
If it's that bad there have probably been lots of complaints to the council already and it might not take that long to get rid of the noisy neighbours. Also talk to any other neighbours (not the noisy ones) and your landlord to find out how long it's been going on and what has already been done. If a group of you complain at the same time it will probably work better with the Council as well as it would be clear that it's not just a personal problem. It will cost you money to get out of the contract so I suggest you investigate if you can get rid of the noise first. Good luck and hang in there.

Even the w*nkers upstairs need to sleep at some time don't they...obviously they sleep from 4 am until noon.
what you need to do is get a boombox with a particularly large sub woofer, and blast Chris de Burgh at 5 am on a repeating loop "Lady in Red" should do the trick. Do it from 5 am to 10 am for three nights and the upstairs music producers will be begging for mercy once their coke high wears off around 6 am.
