the buggers aren't handing over my rent

 

I'm smelling a big rat. Because I have fantastic tenants, I've opted to keep the toxic Foxtons as my managing agents for my flat in central London. The tenant pays the rent on the knocker each month, but Foxtons takes up to a week to transfer the funds into my account. This month is an all time record - 11 days and still no sign of MY money. They say it's the tenants' fault. But it's not. The money left the tenants' account on the correct date. Each day there is a new reason why they haven't given me MY MONEY!! Does anyone know if I have any redress here? Can I for example, ask the tenants to pay me direct and tell Foxtons to go jump because they are incompetent. THey already have their year's commission out of me, so why should they hang on to my money. In the meantime, I'm in overdraft because of this.

Any advice gratefully received.

Hi there,

It is your money so if you paid your commission in advance then you need to speak to the tenants, get them to cancel their standing order with foxtons and then get them to set up a new one.  The only reason they wont let this happen is because this is the only way they can charge you a renewal commission.

 If you have incurred any charges and you have proof from the tenants they paid in time, they foxtons should be made to pay your costs. 

 Good luck, and please next time use an ARLA registered agent.

I do not work for Foxtons and never would but I do know that without a good letting agents then landlords and tenants would be getting turnt over left, right and centre.

In fact the main reason why tenants call private adverts out of the the gumtree and the loot(for example) is because they know that there will not be any proper checks, a proper impartial inventory and the lanldord will probably not have a clue about the legalities involved in letting a property.

Also if you agree and sign to an agents terms and conditions then you have to pay the renewal fee even if you change the standing order or contract as you will be bound by those terms.

All the wise and astute landlords I work with get in with their letting agent to make sure they get a good rent increase, sound advice and more importantly are fully covered with the legalities involved with lettings. Or alternatively let it yourself and get will eventually lose out!

Yes you are correct ARLA agents do charge commission, but they pay the landlord the rent on time.

Definitely ask your tenants to cancel their standing order to Foxtons and pay you directly. Foxtons don't like this happening because they might lose out on renewal commission, and will tell you that, should your tenants fall into arrears, then they will be unable to help you as you are collecting the rent yourself. If both you and your tenants are happy with this arrangement GO AHEAD AND DO IT. Believe me, I worked for Foxtons Property Management-99% of the time payments are received on time-it can take slightly longer if the tenants haven't put the exact reference required on the standing order mandate, but even so, they are the slowest company I know when it comes to assigning payments. It states in your terms and conditions that it can take a few days for payments to be transferred to you, but on the whole they are nothing short of ridiculous. I can safely say that of the 6 people who work on the payments team, only one was fanatastic and in any was helpful to both staff and clients.

Everyone, thanks for the advice. I'll contact my tenants nd get them to pay me direct. Phew. As if life isn't complicated enough without companies like Foxtons  deliberately making matters worse.

We used Foxtons to let our flat i 2007. Although the tenamt paid the rent on time and in full there were always excuses/lies why there was such a delay in the money being transferred. Eventually we just made a complete nuisance of ourselves and kept phoning their freephone number 0800 138 6060. This really annoyed Foxtons (pity) but we did get the rent. At the first opportunity we sacked them.

Same problems. How did you sack them? Can you retain the tenant if sacking Foxtons?

 

For the record

Foxtons are a member of ARLA and the Ombudsman scheme. Call and ask any of their offices. Hopes this clears things up on that front.

Let my house with Foxtons for 3 years.  The Terms and Conditions stated that they will pay interest at 4% above HSBC base rate if rent is delayed by more than 10 days.  I got them for interest on one occasion only.  Most of they time, they paid after just 9 days.  I paid 17% commission + VAT (i.e 20%) for a very poor service, including Contract for £320 + VAT (you can get a Law Pack Landlord's contract from WHSmith for £6.99).  Ditched them 3 months ago for Haart who only charged me 7% + VAT and charged me contract for £6.99 only and found me some wonderful tenants.

Yeah, if you've worked for them you know they keep the rent you're due as "unwritten" company policy. It all goes into the same high interest account along with all the tenants' deposits they avoid paying back too.

I am using Foxtons and I know that they said if it is over 10 days you will be paid interest on the monies owing, so they will pay you anything over the 10 days interest, so if you waited 15 days they would pay interest on 5 days. Not much but you are entitled to it. Hope this helps

Ask to collect rent yourself

Tell the tenant to pay you directly, email foxtons to say you're collecting the rent directly, pay any due commissions. Job done. They're fine with this by the way.

A quick note...if you get on well with your tenant, i would ask them to pay you directly. The other problem comes in tht foxtons holds on to the deposit.

 Way around this - you ask ur tenant to tell foxtons they wud like to give notice. Foxtons pays the deposit to the tenant and you do an exit inventory. U can set ur own tenancy agreement (free off the internet) with the tenant- there is no legal obligation to pay renewals

those who think they will have problems with rent arrears should get rental insurance (usually cheaper frm the agent) but u can get through the internet also - shop around

 by cheque to them its takes 3to4 days to clear the cheque then another 3to4 days

 takes come to my account. They pay 1st month on 10th then 2nd on 13th,3rd on 16th 4th on 18th 5th on20th 6th on 24th 7th on 22nd 8th when due  end of the month

I was ill and I went to hospital for 7days when I back I phone them they told me the

accountant on holliday he will back next week then we can tell you.After 1 week I went

to agent they told we pay to your bank but I did not get rent then I contact with tenant

they told me they pay 8 days b 4 due date so the agent owe me 2months rent. Now I am collecting the rent. They refuse to return deposit money oneday tenant went to agent and shoutly tell them return my deposit other wise Iwill fight.They return deposit becouse my tenant was over 6 fit tall the agent was coward indian malaun. I am taking them to court now my tru story end
