need help! they are holding my money!

hi all, thank you for reading this and ill get straight to the point.

ok, two months ago, i signed a contract with foxtons for a property to rent out. they gave two weeks for the contract to start. on the day i was due to move in (monday), they told me that the carpet hadnt been laid yet, which i thought to be unacceptable, but still decided to run down to the office, get the keys and have a look.

upon arrival i discovered that no work had been done yet, and also met the landlord installing a new washing machine. i got a bit mouthy with him at first but he explained that he had informed foxtons 4 days before that the carpets not being ready till two days after the contract had started (wednesday). so obviously theres a been a real delay in foxtons passing on that message to me.

so.. i decided to go to their office and cut the contract and after two bloody hours they verbally agreed to do so and said that itll take 4-5 working days to get my money back. the next morning they called me up saying it would take 3-4 weeks. since then i have been calling up almost every day to get my money back and seems like they are just taking me for a ride. the whole sum consists of admin fee, deposit and a months advance rent.

Hi there,  the contract you signed is with the landlord, there is no contract with Foxtons.  There are a few things you can do here.  1. Contace the landlord, get him to get the money from them and then get him to pay you the money back. 2. Contact the landlord, his address is on the lease, and get him to put in writing that the lease is not going ahead.  Then you go to the local county court, take out a summons against them, costs about £40 and take them to court for your money, plus costs. They are regulars in all county courts and you will have no problem getting your money back. 3.  If you still want to live in the property, move in and deduct the amount of rent you would have paid for the lost time in the property from the second months rent. 4. Speak to Citizens advice and as them how to take out a bankruptcy order on them as they owe you money and wont pay it back, if they dont pay it back you can get a wind up order on the company.

I hear horror stories like this on a daily basis about Foxtons, they dont care one bit about how they treat people and do exactly what the want, including stealing tenants and landlords money and even keep deposits. If you decide to rent another property use an ARLA or NAEA registered agency, Knight Frank, Savills or King Sturge are the best ones to use, they follow all the rules and are very professional.
