Foxtons Illegal Entry To Our Home - A growing culture?

Our landlord is selling our property. Foxtons are not our letting agents and in accordance with our contract, they have absolutely no right of entry. We told foxtons they couldn't come on a certain dayas we would be out and didnt want them inside without one os us being present. They ignored us and came anyway with a set of keys my landlord had given them. I was in the bathroom and came out to find them showing a potential buyer around. I went mad and threw them out. They seem to think its ok and tried to justify their actions. I really get the impression they do this a lot. I've heard other similar stories.

Im normally really reasonable but their response to my complaint has really annoyed me.

Anyone with a similar experience?

Im not letting this one down.

They have commited trespass!

Change the locks, and send the bill to the landlord. NO ONE is entitled to enter your property without your permission, rented or otherwise.

if it was an illegal entry, why not file a police report?

can any solicitors provide guidance?

Yes but the agent will say

Yes but the agent will say that they left a message with the tenant giving the correct notification of a viewing, and it will be your word against theirs. So how do you tell who is telling the truth or not?!

are bunch of tossers they charged me a lot of fees when renting my property it turns out i had paid double

As a tenant you have right of exclusive possession. This means you can exclude anybody from the property, including the landlord. If the landlord or any of his agents wish to enter the property, they may only do so with your prior consent. Problem here is that Foxtons may not have known that your landlord didn't get your consent to let them show people around.

Actually this is wrong

If the rent on your property is less than £25k a year and the term is 6 months or longer you are bound by the housing act (regardless of what your tenancy agreement says). The Housing Act states that the landlord, or the landlord's agent may enter the property as long as they have give you 24 hours notice. They do not need permission, they just need to give notice - this notice can be via phone (including voicemail) or letter.
