A lawsuit has been filed and is seeking class action status against the discount real estate brokerage for allegedly firing employees without sufficient warning. The lawsuit was filed in Federal Court in Trenton, NJ and claims Foxtons laid off 350 of its 380 workers in late September without 60 days notice as required by the Federal WARN Act.

Founded in 1999 as YHD Realty, Foxtons offered commissions ranging from 2 to 4 percent, compared with the traditional 5 percent or 6 percent charged by most real estate agents. In recently filing for bankruptcy protection, Foxtons listed its liabilities at $40.9 million and assets at only $487,757.

The former employees who were part of the layoff filed a lawsuit this week charging that Foxtons did not provide sufficient notice and benefits to a group of 350 employees terminated on Sept. 26.David A. Krenkel, a lawyer who is representing the former employees in the lawsuit, said that Foxtons has not yet been served with the complaint and should receive it next week. Foxtons officials were not immediately available for comment about the lawsuit.The Oct. 4 lawsuit, which seeks class-action status, alleges that Foxtons violated the federal Worker Adjustment and Retraining Act.That act generally requires employers to provide “notice 60 days in advance of covered plant closings and covered mass layoffs” for employers with 100 or more employees, “not counting employees who have worked less than six months in the last 12 months and not counting employees who work an average of less than 20 hours a week.”The lawsuit also charges that Foxtons is liable to pay 60 days’ worth of wages and benefits to the terminated Foxtons employees under the U.S. Employment Retirement Income Security Act. I use to work for this company and now I found out that Mr. Hunt has enough money to bill a trench basement in his new home while 350 people are out of jobs with same day notice!!!! I hope they go after John Hunts money!!!!!!!!!!
